Service details, timelines, deliverables, and pricing are confirmed in proposals, statements of work, or written agreements between you and us. Website content is for general information and does not itself create a binding service contract.

3. Quotes and Engagements

We may collect the following when you request a quote or begin a project:

  • Quote requests and estimates are informational unless accepted in writing by both parties.
  • Project scope, fees, payment schedules, and revisions will be defined in the applicable agreement.
  • We reserve the right to decline projects that conflict with our policies, capacity, or legal requirements.

4. Client Responsibilities

You agree to:

  • Provide accurate information, manuscripts, assets, and approvals needed to perform the services
  • Ensure you own or have rights to all materials you provide to us
  • Respond to requests for feedback within agreed timelines
  • Use our services only for lawful purposes and in compliance with platform rules (for example, advertising policies)

5. Payments

Fees are due according to the payment terms in your proposal or agreement. Work may be paused or canceled if payments are late. Unless otherwise stated in writing, deposits and completed work fees are non-refundable. Third-party advertising spend, publishing fees, or platform costs are separate from our service fees unless explicitly included.

6. Intellectual Property

You retain ownership of your book content and materials you supply. Upon full payment, you receive the agreed rights to final deliverables created specifically for your project. We retain ownership of our pre-existing tools, templates, processes, branding, and website content. You may not copy, resell, or redistribute our proprietary materials without written permission.

7. Marketing Results Disclaimer

Book marketing outcomes depend on many factors outside our control, including market conditions, platform algorithms, audience response, and the quality of the underlying work. We do not guarantee specific sales numbers, rankings, reviews, or advertising performance. Past results do not guarantee future results.

8. Acceptable Use

You may not use our website or services to:

  • Violate any law or third-party rights
  • Upload or distribute harmful, infringing, or deceptive content
  • Attempt to disrupt, hack, or reverse engineer our website or systems
  • Misrepresent your identity or affiliation with our company

To the fullest extent permitted by law, Author Spark Agency is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost sales, or reputational harm, arising from your use of our website or services. Our total liability for any claim related to the services will not exceed the fees you paid to us for the specific services giving rise to the claim in the three (3) months before the claim.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your materials, your breach of these Terms, or your violation of any law or third-party right.

13. Termination

Either party may terminate an engagement as allowed in the applicable agreement. We may suspend or terminate website access or services if you breach these Terms, fail to pay amounts due, or misuse our services. Provisions that by nature should survive termination (including intellectual property, payment, liability, and indemnity) will survive.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes are posted means you accept the updated Terms.

15. Governing Law
